Terms of service
Thank you for visiting ™ غَيْرُ مُقَرَّرً | YNDECIDED. These terms apply to your use of yndecided.com and to every order you place with us. By using the website or placing an order, you confirm that you have read and accepted them.
1. Who we are
This website is operated by Designs and Arts Trading, registered in Arabic as (شركة التصاميم والفنون للتجارة (شركة شخص واحد)), trading as (™ غَيْرُ مُقَرَّرً | YNDECIDED), commercial registration number 1010768880, VAT registration number 314442544600003, (“™ غَيْرُ مُقَرَّرً | YNDECIDED”, “we”, “us”), a company registered in Riyadh, Kingdom of Saudi Arabia. Our contact details are on our Contact Information page.
2. Using the website
The website and its content are for your private and personal use. You agree not to:
- Copy, resell or commercially use our products, images, texts or designs;
- Interfere with the website or try to gain access to our systems;
- Give false details or use a payment card that is not yours.
You must be 18 years or older, or have the permission of a parent or guardian, to place an order.
3. Your account
You need an account to place an order. Please keep your details accurate and your login code private. You are responsible for what happens under your account, and you should tell us at once if you think someone else has used it.
4. Our products
We take great care to show our pieces as they are. Colours may look slightly different on different screens. Each product page shows its measurements, and the size guide helps you choose your size. Small differences in fabric, print or finish can happen. These are part of the character of the piece and are not defects.
5. Authentic products and where we sell
™ غَيْرُ مُقَرَّرً | YNDECIDED products are sold through our own website, yndecided.com. If we also sell on other online platforms, we do so under the brand name ™ YNDECIDED or ™ غَيْرُ مُقَرَّرً | YNDECIDED or ™ غَيْرُ مُقَرَّرً, so you can recognize that the seller is us.
Products offered by sellers who do not appear under the brand name ™ YNDECIDED or ™ غَيْرُ مُقَرَّرً | YNDECIDED or ™ غَيْرُ مُقَرَّرً, are not sold or authorized by us. We cannot confirm the authenticity, quality or condition of those products, and any such purchase is made at the buyer’s own responsibility. We reserve the right to take action against counterfeit and unauthorized sales to protect our brand and our clients.
6. Availability
All products are subject to availability. We work to keep our stock information accurate, but a product may sell out before your order is accepted. If an item you ordered is not available, we will tell you and refund that item in full.
7. Prices, offers and VAT
All prices are shown in Saudi Riyals (SAR) and include VAT, excluding delivery charges. Delivery charges, where they apply, are shown at checkout before you pay. The price shown when you place your order is the price you pay. If we find a pricing error, we will contact you before dispatch and you may confirm the order at the correct price or cancel it for a full refund.
Offers and discounts apply as described at the time, for the period stated, and while stock lasts. A discount cannot be added to an order after it has been placed.
8. Payment
You can pay with the payment methods shown at checkout. By paying, you confirm that you are the authorized holder of the card or account you use. Payments are processed by secure third-party payment providers. We do not store your full card details.
Some methods, such as pay-in-instalments services, are offered by third parties such as Tamara installment payment or Tabby installment payment and are also subject to their own terms.
9. Your order and our contract
After you place an order and pay, you will receive an email confirming that we have received it. Our contract with you begins when we send that confirmation. We will then prepare your order, and we will send you the delivery details once it has been handed to the carrier and is on its way to being delivered.
We may cancel an order before dispatch, for example when a product is unavailable, when there is a pricing or product information error, or when we cannot verify your payment or details. If we do, we will tell you and refund you in full.
You may cancel your order at any time before we dispatch it by writing to us. We will refund you in full.
You will receive an invoice showing the price, VAT, delivery charge, delivery address and expected delivery date.
10. Pre-orders
10.1 What a pre-order is. Pieces marked "Pre-order" are sold before they arrive in our warehouse, so that you can reserve a piece before the public. They are offered to the public after the public launch, which takes place once we have received the pieces in our warehouse.
10.2 Payment. You pay the full price shown at checkout when you place a pre-order, using the payment methods shown at checkout.
10.3 Dispatch and delivery time. The expected dispatch date is shown on the product page. It is an estimate of up to 30 calendar days from the date you place your order. If the pieces reach our warehouse later than planned, the dispatch date may move by up to 14 further calendar days. The dispatch date shown when you order, including this possible extra period, together with the delivery time of the carrier you choose at checkout, is the delivery time agreed with you.
10.4 Orders with more than one item. If your order includes both pre-order pieces and in-stock pieces, we will send the in-stock pieces first and the pre-order pieces when they are ready. If you prefer to receive everything together, please contact us before your in-stock pieces are dispatched, and we will hold them and send everything in one parcel. You pay delivery charges once, as shown at checkout.
10.5 Delays. If your pre-order will be delayed beyond the agreed delivery time, we will tell you the new expected date. The late delivery section of our Shipping Policy then applies, including your right to cancel and receive a full refund.
10.6 If we cannot supply a piece. If a pre-order piece cannot be made available, we will tell you, and you may choose one of the following: a full refund of what you paid for that piece; another product, where we will tell you any price difference before you confirm; or, if only your size is unavailable, a different size of the same piece, where available.
10.7 Changing or cancelling before dispatch. To change or cancel a pre-order before it is dispatched, write to cx@yndecided.com. If you cancel before dispatch, we will refund you in full to your original payment method. Changes, such as a different size, depend on availability.
10.8 Returns and exchanges. After delivery, pre-order pieces are returned and exchanged on the same terms as other pieces, as set out in our Refund Policy.
11. Gift orders
You can send an order as a gift by entering the recipient’s name, phone number and address at the checkout. Before hand in the cart you are able to select if the order is for yourself or as a gift for someone else, and you will be able to select if you want your name “the gifter” to be seen by the “giftee”, you will also be able to select if you want the prices are to be displayed for the “giftee”, in addition you can provide us with a note or instructions in the text box provided at the cart. You are the person we contract with, and you are entirely responsible for giving correct recipient details. Your name and the prices appear on the recipient’s receipt only if you choose that. Returns, exchanges and refunds are handled with you as the buyer.
12. Delivery
We deliver using national and international carriers. Delivery times, charges and conditions are in our Shipping Policy, which forms part of these terms. For deliveries in Saudi Arabia, please give your Short Address, and for international deliveries please follow the country’s laws for accurate delivery.
13. Checking your order
Please check your order when you receive it. If an item is damaged or is not what you ordered, please tell us as soon as you notice, with your order number and photos, so we can help you quickly. If you notice a mistake in your order, please write to us as soon as possible and we will put it right where we can.
14. Returns, exchanges and refunds
You may return an item within 7 days of delivery and exchange it within 14 days of delivery, as set out in our Returns, Exchanges & Refunds Policy, which forms part of these terms. We pay the cost of returning your item. Refunds go back to the payment method you used. Personalized items cannot be returned or exchanged, because they are made for you.
15. Our commitment to quality
™ غَيْرُ مُقَرَّرً | YNDECIDED does not offer a commercial warranty on its products. We do promise to take the best care of our clients. If a product arrives damaged, has a manufacturing fault, or is different from what you ordered, please contact us as soon as you notice, with your order number and photos. We will replace or refund the product at no cost to you.
Damage caused after delivery, such as wear, washing, misuse, alteration or accidents, is not covered.
16. Intellectual property
The brand name (™ غَيْرُ مُقَرَّرً | YNDECIDED), the Arabic name (™ غَيْرُ مُقَرَّرً), the English name (™ YNDECIDED) our logo, designs, artwork, photographs, texts and all other content of this website belong to us or are used with permission, and are protected by Saudi intellectual property laws. You may not copy, adapt, share or use them without our written permission.
17. Website availability and information
The website may be closed or unavailable from time to time for maintenance, security or technical reasons. We work to keep the information on it accurate and up to date, and we may change its content at any time.
18. Our responsibility
We are responsible for foreseeable loss or damage caused by our failure to follow these terms or by our negligence. We are not responsible for losses that were not foreseeable, for business losses if you use a product commercially, or for errors in third-party content. Nothing in these terms limits any responsibility that cannot be limited under Saudi law.
19. Events beyond our control
We are not responsible for delay or failure caused by events beyond our reasonable control, such as natural events, government decisions, strikes, carrier disruption or failure of utilities. We will tell you if your order is affected. If delivery is more than 15 days later than the agreed date because of such an event, you may cancel the affected order and receive a full refund.
20. Privacy and cookies
How we use your personal data, including sharing it with carriers and payment providers to complete your order, is explained in our Privacy Policy.
21. Complaints
Please write to us first at cx@yndecided.com. We will do our best to resolve your concern fairly and promptly.
22. Changes to these terms
We may update these terms from time to time. The version published on the website on the day you place your order applies to that order.
23. If a part of these terms is invalid
If any part of these terms is found to be invalid or cannot be enforced, the rest of the terms remain in force.
24. Governing law and courts
These terms are governed by the laws of the Kingdom of Saudi Arabia. Before taking legal action, we encourage both sides to try to resolve any dispute amicably, starting with a written message to cx@yndecided.com. Any dispute that cannot be resolved this way will be heard by the competent courts in the Kingdom of Saudi Arabia.
